The National House of Chiefs, the apex institution constitutionally mandated to handle chieftaincy matters, has declared that the alleged self styled chief of Gomoa Fetteh, Nana Abore Yamoah II is not a chief, as per the House’s cancellation and extraction of the alleged self-styled chief’s Gazette on the 16th of July,2014, and his loosing of a contempt case brought against same House by the then chief at the Cape Coast High Court.

The declaration is in relation to the alleged preparation by the said Nana Abore

It would be recalled that, a section of the youth are threatening to resist every effort by the ‘chief’ to celebrate the Festival, which they see as disrespect to the court and tradition.

It would also be recalled that the National House of Chiefs on the 16th of July, 2014 cancelled and withdrew the Gazette of the said ‘Chief’, which Gazette was allegedly obtained through questionable means, including (but not limited to) the fact that his Gazette was allegedly obtained on a Sunday, also that he used Kumasi Traditional Council CD forms and stamp to acquire his Gazette.

The ‘chief’ is alleged to be sending letters to various quarters to the effect that he is requesting them to be part of the Akwanbo Festival he intends to celebrate as a chef of the community.

Consequently, the youth and other factions are threatened to resist such move by the chief since they see it as complete disrespect to the whole community and our justice system.

The youth asserted that, in 1997, as per a successful appeal heard at the Regional House of Chiefs on the legality of the cancellation of the Gazette of the then chief, Nana Abor Ewusie XII, which appeal declared the earlier action as illegal, the chieftaincy of Nana Abor Yamoah, also known in private life as Edward Acquaye was made illegal.

They revealed that, the Kingmakers at that time then performed all traditional rites needed to destool him, and did so according to tradition. As a result, various searches at the Traditional Council in the year 2005 indicated that Gomoa Fetteh had no chief.

Adding that, In 1999, the then President, H. E. Flt Lt (Rtd) Jerry John Rawlings constituted a Gomoa Fetteh management Committee to administer affairs of Gomoa Fetteh, especially land issues until a new chief was installed.

According to the youth group of the community, these facts are core to the determination of whether Gomoa Fetteh has a chief or not.

It would be recalled that the said ‘chief’, Nana Abor Yamoah II successfully obtained an Order of Mandamus through Judicial Review at the Cape Coast High Court against the Regional and National Houses of Chiefs in the case, “The Republic vrs The Registrar & President NHC, Kumasi; The Registrar & President Central House of Chiefs Cape Coast, Ex-Parte: Ebu. Kojo Yamoah and Nana Abor Yamoah II, in which case applicants prayed the court to grant an Order of Mandamus through Judicial Review to order the respondents to take steps to re-instate the Gazette of the applicant.

In a related development, the Cape Coast Appeals Court has stricken out a contempt case brought against the Regional and National Houses of Chiefs, in the case “The Republic vrs Wuhugu Nanba Pugausu Naa Nabilla, President National House of Chief and Daasebre Kwebu Ewusie VI, Ex-Parte: Ebusuapanyin Kow Abaka and Nana Abor Yamoah; in which case the applicants were praying the honorable Court to commit the respondents of contempt in relation to the refusal of same in implementing orders of the above case, the Order of Mandamus.

The honorable Court under Justice William J. Boampong ruled as follows:

“I RULE THAT THE PRESENT APPLICATION IS UNSUSTAINABLE AND SAME IS DISMISSED; The 1st Respondent is found NOT Guilty, he is accordingly acquitted and discharged”.
